Mark Uremovich is an experienced legal advisor and litigator who represents developers, contractors, HOAs, and homeowners. Mark provides a wide range of legal services to both large-scale developers and small contractor companies. Such services include contract drafting, compliance with statutory requirements related to construction and development, warranty claim and repair evaluation, construction defect avoidance strategies, insurance coverage evaluation, and much more. Mark also represents HOAs as general counsel on all matters ranging from drafting CC&Rs, compliance with the Davis-Stirling Act, and daily operation. Additionally, Mark advises and represents homeowners in disputes involving property law, including boundary lines, views, encroachments, easements, and all related areas of property law. Mark represents all of his clients in insurance coverage disputes, whether it requires triggering additional insured obligations, obtaining coverage for covered losses, or filing bad faith claims against insurers.
If one of Mark's clients is involved in a dispute, Mark's representation provides over 15 years of trial and arbitration experience. Mark is known for creative dispute resolution, but will take the fight to the courtroom if necessary. Mark started his legal career working in a successful boutique construction advisement and litigation firm where he made partner before founding his own law practice. Mark represents his clients as both plaintiffs and defendants in civil and business related matters involving contract disputes, negligence and other torts, construction defects, and insurance coverage.
Some of Mark's accomplishments and victories include the following:
Recently, Mark represented a homeowner whose home suffered extensive damage when his sump-pump failed during a heavy rainstorm. Prior to the incident, the homeowner obtained an endorsement to his homeowner's insurance policy from a national insurance company covering the very risk of his sump-pump failing. The insurance company immediately denied the homeowner's claim citing numerous exclusions that essentially rendered the endorsement ineffective. After filing a bad faith claim against the insurance carrier, Mark resolved the claim in his client's favor obtaining the full amount for his client's repairs.
In 2021, Mark represented a contractor that performed five years of construction work for its client who subsequently refused to pay for the work. Mark's contractor client was owed over $1,000,000.00 for the work it performed. After filing suit, the Defendant called Mark's client's claims "bogus" and forced protracted litigation. During the mandatory settlement conference, the Defendant offered Mark's client $350,000.00 to settle the matter, far below what the client was owed. Calling the Defendant's bluff, Mark took the matter to trial and on the first day of trial the case settled for $1,250,000.00. Furthermore, two of the Defendant's Board of Directors immediately resigned from the Defendant corporation.
In 2019, Mark first chaired a multi-week trial in San Diego County, wherein Mark obtained a complete defense jury verdict for a homeowner. Plaintiffs demanded a tear down order to remove his client's home addition and damages of nearly half a million dollars for claims of fraud, breach of contract, and misrepresentation. After the verdict in his client's favor, Mark further obtained an attorney's fee award for his clients that resulted in the return of over $300,000.00 in fees.
In 2016, on behalf of a defendant developer, Mark disposed of an entire lawsuit in Los Angeles County that included claims for strict liability, negligence, breach of warranty, fraud, and unfair business practices. The trial court originally issued a tentative ruling siding with the Plaintiffs, but after Mark argued the motion at the hearing, the court reversed course and granted the Defendants’ Motion for Summary Judgment and the case was dismissed. The Court of Appeal subsequently upheld the judgment Mark obtained before the trial court.
In 2015, Mark represented a contractor client in a multi-week trial in San Diego County, wherein Mark and his team obtained a complete defense jury verdict. Plaintiff demanded over $1,000,000.00 for claims of breach of contract, negligence, and fraud.
In 2013, Mark co-chaired a six-week jury trial in Riverside County that resulted in a $3,000,000.00 settlement in favor of his HOA client. Prior to trial, the defendant offered Mark’s client less than $100,000.00 in settlement.
In 2012, in representation of a Master Association, Mark first chaired and won a binding arbitration over a water usage dispute for a forty-story mixed use building. The arbitration award is expected to save Mark's client over $1,000,000.00 in water bills over the next decade.
Mark’s accomplishments are recognized in the community. In 2013, the Daily Transcript nominated Mark as one of San Diego's "outstanding young attorneys." Mark obtained his J.D. from California Western School of Law, where he graduated cum laude. During his time in law school, Mark externed for the Honorable James F. Stiven (ret.), Federal Magistrate Judge for the U.S. District Court, Southern District of California, and Judge Judith L. Haller, Associate Justice for the 4th District Court of Appeal. In 2003, Mark obtained his undergraduate degree from the University of Michigan with distinction. In addition to the practice of law, Mark served on the University of Michigan Alumni Club of San Diego’s Board of Governors and founded the Association of Croatian American Professionals.
